Do I need a Health Care Directive? 801-676-5507 Utah Attorney Mike Anderson explains...

So it seems that alot of people have questions about Health Care Directives (they are also called Living Wills or Health Care Powers of Attorney).

I was asked by a new client -- > Do I really need a health care power of attorney?

Answer - Well, yes, of course you do.

Unless of course, you want to be held captive to hospitals and doctors who will profit at you being brain-dead, on life support, and them keeping you alive for as long as your insurance will pay (or as long as you have assets that can cover the costs) (or as long as the government will foot the bill for).

Yes, I know I'm a little crass sometimes, but hey, this is the truth my friends.

I mean, come one, you don't want to be stuck in a hospital any longer than you have to be, right?  And if you are like me, when I'm braindead, when my mind is gone, when I'm only alive because a machine keeps me alive, then pull the plug because I don't want that kind of life.  Most of my clients don't want that either.

We all want to feel good.  Live a long life.  Live a functional life, as long as we can do so.

I've never met anyone who's said to me -- Mike, I don't want them to pull the plug.  Or Mike, make sure they keep me on a ventilator for as long as possible.

NOOOOO!!!!

You wouldn't either.  Am I right?

When Should I get a Will done? Sooner or later we all die...

So I met with a couple yesterday who said

"OH, WE HAVE AT LEAST 20 MORE YEARS BEFORE WE DIE..."

What?!?!?

Are you kidding me?

Seriously people, we don't know when we're going to die.

Now is the time to get your estate planning done.

Not in 20 years.

You might be dead by then...

And these folks are in their 50's...

Yup,


You'll see.

Now is the time to get that will drafted.

You'll be glad you did.

What is a Trust for estate planning purposes?

Have you ever heard that you need a "Trust"?

I mean, what is a trust anyway?

A trust is a legal entity that exists only in the contemplation of law.  It is ficticious.  It does exist.  It is like a real live person, but it really only exists on paper.

Watch this video and tell me what you think:

A trust was first created under the laws of England when knights would "trust" their neighbors while they left on crusades for Christianity and when they came back, their things which were held in "trust" were given back to them.  You know my law school professor didn't tell me this, I actually learned this from Jeremy Eveland, who told me about it and then I verified that it was true!!  The laws in the United States came from (or were based on) that laws of England originally, so that's how we in Utah eventually got our Trust law from.

Do you need a trust like the knights of England?

Maybe you do.

Maybe you don't.

You ought to speak with an attorney about it.

A last will and testament (commonly called a "will") is a statement of what you want to have happen to your personal property and your real property when you die.  It tells the administrator of your estate (we used to call them "executors") what to do with your things.

I thought about how I could best tell people about myself and it occurred to me that I am nothing like the other attorneys out there.  I am an entrepreneur at heart and that’s what I love.

I could make a VERY L O N G list of all of my educational attainments and how great and wonderful I am, but that truth is – I’m just like you.  I’ve done some great stuff, but I’ve done some cruddy stuff too.  I’ve worked hard, but so have you.  What’s important about me is that I can help you.  That’s it.  Nothing more.  I can get the job done.  That’s what I’m good at.

People who want a lot of Bull go to a Butcher. People who want results navigating a complex legal field go to a Lawyer that they can trust.

That’s where I come in. I am Michael Anderson, an Attorney in the Salt Lake area focusing on the needs of the Average Joe wanting a better life for him and his family. I’m the Lawyer you can trust.
